Abstract

The Editors' Message for Volume 1, Issue 2. It introduces the five articles, the Recent Court Decisions survey across eighty-four jurisdictions in thirty-six source languages, the eight new Foundations entries, and the new departments Comparative Practice and Protocols, the latter opening with a draft procedure put out for comment. It then sets out what the quarter's survey found: that legal systems differ not only in what a taking must pay but in how that figure is reached, and that the reconciliation between approaches, treated in the inaugural issue as an exercise of professional judgment, is increasingly performed by statute. South Africa's Expropriation Act of 2024, Nigeria's unexhausted improvements, Sweden and Finland's statutory twenty-five percent, Poland's restricted cost approach, Germany's purpose-specific Grundsteuerwert, the valuation-date holdings in India, Pakistan and Türkiye, and Egypt's ruling that a claim for expropriation without due procedure never prescribes are each cited to a verified source. Two developments in the Americas sit at the edge: Quebec's move to market value, and a British Columbia declaration of Aboriginal title over land held in fee simple, which asks whether the register states what is owned. The message closes by stating plainly what this issue does not cover — the jurisdictions omitted and why, the entries resting on secondary sources, and a caution against relying on the Journal's English descriptions alone.
